In these terms and conditions:

  • "You" or "your" refers to the person who books a stay at Hatchers Farm.

  • "We", "us" or "our" refers to Hatchers Farm.

1

Your Booking

1.1

We reserve the right to both accept and decline bookings entirely at our discretion.

1.2

All bookings are formally confirmed via email. This email will set out the dates of your booking.

1.3

You, as the person having made the booking with us, are responsible for all members of your party. You, as the person in charge of your party, must be at least 18 years of age by the first day of your booking.

1.4

Children under 16 years of age must be accompanied by an adult and supervised at all times.

1.5

We can only discuss your booking with you. We cannot discuss the booking with another member of your party unless express consent is given to do so.

1.6

By booking with us, you agree to our Terms and Conditions.

Payment

2.1

You must pay us the total amount payable for your booking upon arrival.

2.2

We will only accept payment by cash or bank transfer.

2.3

Any promotional offers will only be applied if they are valid and redeemed upon booking. We reserve the right to change or withdraw any promotional offer at any time.

2.4

In cases where a balance remains unpaid, we'll remind you by email, telephone or in person. If you fail to make the relevant payment, we'll assume you want to cancel your booking. If this happens, your booking will be cancelled with immediate effect and cancellation charges may apply.

Pricing

3.1

We reserve the right to review and amend our prices at our discretion. For the most up-to-date pricing information, please visit the relevant section on our website.

Cancellations

4.1

Your booking is for a specific date or dates, meaning you do not have a statutory right to change your mind and freely cancel your booking. We do, however, allow you to cancel your booking subject to cancellation charges.

4.2

If you wish to cancel your booking, please let us know by email or by telephone as soon as possible, prior to the first day of your booking. Your booking will be cancelled with immediate effect from the day we receive your email or spoken confirmation, subject to cancellation charges.

4.3

Our cancellation charges vary based on a number of factors, including but not limited to, the number of days prior to your booking start date, the number of people in your party and is also subject to an administration fee.

4.4

If you wish to cancel your booking after its start date, we reserve the right not to issue any refunds equivalent to the price of any remaining nights of your booking. This includes cancellations for any reason outside your control, including by not limited to, weather and illness.

Booking Changes

5.1

If you wish to change any details of your confirmed booking, you must let us know via email or telephone as soon as possible.

5.2

Despite the fact that we will always do our best to accommodate you, we cannot guarantee that we will be able to meet any requests for booking changes.

5.3

If you change your booking, we reserve the right to charge an administration fee to cover any costs we incur as a result.

Booking Changes by Hatchers Farm

6.1

We do not anticipate the necessity to make changes to your booking once it has been confirmed and payment has been made. However, there are rare occurrences where these are unavoidable. We will only change or cancel your booking, including but not limited to, in the following events:

6.1.1

If we are required to carry out essential remedial works which impact your booking; or,

6.1.2

For any other reason unforeseen at the time of your booking which are beyond our reasonable control, including where your booking becomes impossible due to severe weather warnings from the Meteorological Office, or any other severe weather event.

 

6.2

In the unlikely event that we do need to change or cancel your booking, we will strive to offer you a suitable alternative booking. If we are unable to agree upon a suitable alternative, the booking will be deemed as cancelled and we will refund you the total amount you have paid us for the booking. This does not include any outstanding payments you still owe at the time of cancellation.

6.3

If we do need to change or cancel your booking, we will only accept responsibility for foreseeable losses that you suffer as a result. We will not be responsible for any unforeseeable losses. A loss is deemed foreseeable if it is an obvious consequence of the change or cancellation of your booking or if it was discussed between you and us at the time of the initial booking.

Visitor Behaviour

7.1

Campsite rules are available on the relevant section of our website. You will also be reminded of the campsite rules upon your arrival. Please ensure you and your party read and understand these rules prior to your booking as well as on arrival.

7.2

You must only use your stay with us for the purposes of your holiday and for no other purpose, including business use, without our written consent.

7.3

You must keep your booked area of the campsite clean and tidy, leaving the area in the same condition as when you arrived.

7.4

The use of your booked area of our campsite for any dangerous, offensive, excessively noisy and/or illegal activities is prohibited. In addition, you must not cause nuisance to any neighbours, fellow campers and/or anyone else during your stay.

7.5

You and your party are permitted to use a barbecue and/or fire pit with our explicit consent. This may incur an additional fee.

7.6

You any your party must not utilise any naked flames or cooking equipment inside any tent.

7.7

Dogs are permitted on our campsite. However, as indicated on the relevant section of our website, the dogs must be well-behaved and must remain on a lead at all times. Guide dogs are also permitted.

7.8

Please note, if you do not comply with the behaviours set out in this section of the Terms and Conditions, we reserve the right to remove you and your party from the campsite.

Campsite Damage

8.1

If you discover any damage at your booked area of our campsite, you must notify us immediately. If you do not notify us, we will assume that you caused the relevant damage.

8.2

You will be responsible for the cost of any damage booked area of our campsite caused by you, by any member of your party, or by any animal brought with you.

Problems and Complaints

9.1

We take all due care to ensure our campsite and all facilities we provide are all at a high standard. However, if you have any problems, please notify us immediately and provide us with the opportunity to solve it.

9.2

In the unlikely event you have an unresolved complaint at the end of your stay, please contact us via email.

9.3

In considering any complaint, we reserve the right to take into account if we have been given the opportunity to solve it.

9.4

We will not tolerate any written, verbal, physical and/or any form of abuse towards our staff, representatives and premises.

Right to Remove

10.1

We reserve the right to terminate your booking and ask you to leave the campsite with immediate effect, without any refund, if certain events occur. These include, but are not limited to:

10.1.1

If we consider that you or your party have breached these Terms and Conditions;

10.1.2

If we consider you or your party are endangering the safety of our visitors, staff and/or campsite and/or premises;

10.1.3

If we receive any complaints of unacceptable behaviour committed by you or your party; or,

10.1.4

If you or your party cause an unreasonable amount of damage to the campsite and/or premises.

11

Liability of Hatchers Farm

11.1

If we fail to comply with these terms, we are responsible for the loss and damage you suffer that is not foreseeable as a result, or in the unlikely event of our negligence. We will not be responsible for any unforeseeable loss or damage. Loss or damage is deemed foreseeable if it is an obvious consequence of  our breach or if it was discussed between you and us at the time of the initial booking.

11.2

Nothing in these Terms and Conditions is intended to limit our liability for:

11.2.1

Death or personal injury caused by our negligence;

11.2.2

Fraud on our part; or,

11.2.3

Any breach of the terms implied by Sections 10, 11 and 13 of the Consumer Rights Act 2015.

11.3

Nothing in these Terms and Conditions will affect your legal rights in respect of you booking. For more information, please visit the Citizens Advice website.

Uncontrollable Events

12.1

We will not be held responsible for any failure to perform our obligations under these Terms and Conditions that is caused by an uncontrollable event.

12.2

An uncontrollable event means any act or event that is beyond our reasonable control, including by not limited to, severe weather, fire, subsidence, epidemic or other natural disaster, war, civil unrest, or failure of telecommunication networks.

13

Practical Information

13.1

Any times for check-in and/or departure will be set out for you in your booking confirmation and/or the campsite rules. If you do not vacate your booked area of the campsite by the required departure time, we reserve the right to charge a late checkout fee.

13.2

If you leave any of your possessions behind, please contact us as soon as possible. We reserve the right to charge any storage and delivery costs we incur in relation to your possessions.

13.3

Our premises is in a rural area and on a working farm. As a result, do not interrupt or endanger the livelihood of those working at the premises or on the surrounding land.

13.4

Wildlife may be present at our premises. Any disturbance by wildlife should be reported to us immediately. Remember that it is illegal to interfere with any protected species or their habitats.

14

Entire Agreement

14.1

These Terms and Conditions constitute the entire agreement between you and us, superseding any previous promises.

14.2

Third parties have no right to enforce any of these Terms and Conditions.

15

Data Protection

15.1

We reserve the right to communicate with you from time to time about your booking and your experience with us, using your data in accordance with our Privacy Policy.
